DC Passes Grocery Store Covenant Legislation

The D.C. Council has passed legislation making covenants or restrictions that restrict the ability of certain property to be used as a grocery store or food retail store void or unenforceable. The Grocery Store Restrictive Covenant Prohibition Act of 2018 is intended to prevent “food deserts” from forming in the District.

The legislation’s impact on already vested covenants and, by extension, title insurance requests regarding affected properties remains to be seen.
