      <title>Advocacy In Action</title>
      <description>&lt;p align="left"&gt;&lt;strong&gt;DCLTA Meeting with Recorder of Deeds and Office of Tax and Revenue Regarding Homestead Tax Reduction Concerns&lt;/strong&gt;&lt;br&gt;&lt;/p&gt;&lt;p align="left"&gt;Several
members of the DC Land Title Association Board of Directors met with senior
members of the District of Columbia’s Recorder of Deeds Office, Assessment
Services Division and Office of Tax and Revenue (OTR) on December 13, 2023 to discuss
concerns the industry is having related to the filing of the Homestead/Senior
Tax Exemption application. In the way of background, in 2020, the OTR’s
Homestead Unit implemented a new policy with required the mandatory electronic
filing of the Homestead Deduction, Disabled Senior Citizen and Disabled
Property Tax Relief Application (ASD-100) This change went into effect as of
October 1, 2021.&lt;/p&gt;

&lt;p&gt;&lt;font style="font-size: 15px;"&gt;DCLTA
Vice President Chris Darby began the discussion by pointing out some general areas
concern title companies are experiencing with this transition from submitting a
hard copy of the ASD 100, filled out at closing by the buyer to the new requirement
that it be submitted electronically through an OTR portal. &amp;nbsp;This new process requires that the buyer submit
this application Post-Closing, outside of the closing table. Given the general overwhelming
nature of a real estate closing, we suspect that there are many buyers simply forgetting
to submit these applications online when they leave the settlement company
office. &lt;/font&gt;&lt;/p&gt;

 

&lt;p&gt;&lt;font style="font-size: 15px;"&gt;In
response to this concern, Frank Bessenyei, the Division Chief for Assessment
Services at OTR suggested that perhaps his office put together a one pager to
be provided to the buyers at closing and included in the hard copy of closing
docs they take home. This document would provide step by step instructions on
how to apply for the homestead/senior citizen and/or disabled property tax
relief application, along with further detail regarding the time frame the
buyer can expect to see their application either approved or denied and other relevant
information association with the new filing system. The industry acknowledged
that for many title companies this is already taking place but acknowledged the
value in their being a standardized set of instructions, crated by OTR for all
title companies to provide to their buyers. &lt;/font&gt;&lt;/p&gt;

 

&lt;p&gt;&lt;font style="font-size: 15px;"&gt;The
next issues brought to the attention of the District staff is the requirement found
in the D.C. statute that a copy of the Homestead Application and proof of its
submission be attached to the FP7-C at the time of recording when the buyer is
a first time DC homebuyer and applying for the reduced Recordation Tax Rate provided
to these individuals. Ida Williams, the Recorder of Deeds, reminded the
industry representatives that in addition to submitting the hard copy of the
application, they must also file the ASD-100 electronically with the Homestead
office. Ida indicated that there is some evidence of these not being recorded electronically
when auditing taxpayers accounts and reviewing whether the applications are
getting filed. &lt;/font&gt;&lt;/p&gt;

 

&lt;p&gt;&lt;strong&gt;&lt;font style="font-size: 15px;"&gt;It
was suggested that we remind our members as to what exactly is required when
presenting the Reduced Recordation Tax Rate for First-Time Homebuyers
Application (Form ROD 11) and FP7-C at the time of recordation. The current
mandate is that ROD will require only the following documents:&lt;/font&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;font style="font-size: 15px;"&gt;Additionally,
it was advised that the deed must be recorded within a few business days of the
electronic homestead application in order to avoid the risk of that the buyers
homestead application will be denied due to the deed being presented for
recordation weeks later.&lt;/font&gt;&lt;/p&gt;

 

&lt;p&gt;&lt;font style="font-size: 15px;"&gt;Kevin
Anderson, President of DCLTA, next discussed the issue being found when
conducting closing of newly created condominium conversion projects. In this
case, while the OTR has issued new 2000 lot numbers for the unit units, it is
taking weeks to months before these lot numbers become visible on the OTR
website. It then becomes impossible to file a Homestead Application until such
time as the lot numbers become visible in the OTR system. &lt;/font&gt;&lt;/p&gt;

 

&lt;p&gt;&lt;font style="font-size: 15px;"&gt;Frank
Bessenyei, provided the solution to this issue (though it won’t be available
until October of 2024). The District is currently working on a major upgrade to
their operating system, called Core 21. This new system will provide that any
new lot numbers issued by OTR, such as the new condominium lot numbers issued once
a project is completed, be instantaneously visible to the public on the OTR
online system, &lt;/font&gt;&lt;a href="http://www.mytaxdc.gov/" target="_blank"&gt;&lt;font style="font-size: 15px;"&gt;www.mytaxdc.gov&lt;/font&gt;&lt;/a&gt;&lt;font style="font-size: 15px;"&gt;. While this will
certainly resolve this aspect of the Homestead credit, Kevin pointed out that
while this is a great and welcome change in DC reporting capability, we still
have 12 months to develop an alternative to the current solution. Currently,
either the tile company or the buyer are required to monitor the OTR website
until such time as the lot numbers become visible at which point the buyer may submit
their Homestead application electronically. Given the potentially lengthy time
span from the date of closing until the time the lot numbers become visible,
Frank suggested a separate meeting with Kevin Anderson and anyone else interested
in this issue to try to develop a temporary solution to this problem. &lt;/font&gt;&lt;/p&gt;

 

&lt;p&gt;&lt;font style="font-size: 15px;"&gt;Chris
Darby and Katie Griffin brought up the final issue discussed in the meeting and
that being the audits associated with the Homestead Tax Reduction. Among other
aspects of the audit process, a conversation was had regarding the ordering by
title companies of Tax Certificates as part of a settlement and exactly what assurances
we as an industry can derive from that document. Frank Bessenyei, offered to
have a more in depth conversation with Chris Darby and any others in the
industry to discuss these audits in more detail and possible solutions to some
of the concerns we see as a result of these audits. &lt;/font&gt;&lt;/p&gt;

 

&lt;p&gt;&lt;font style="font-size: 15px;"&gt;The
meeting closed with a comment and suggestion from Frank Bessenyei, that we schedule
these types of meetings on a regular basis (quarterly perhaps) allowing for
both the industry and DC Government discuss any ideas, concerns or issues being
realized by both groups. success being that to have the most effective
partnership between the industry and DC Government&lt;/font&gt;&lt;/p&gt;

Office of Tax and Revenue (OTR) recently issued a
notice that; effective August 1, 2023 the OTR Building (Floors 5-7) will undergo
extensive renovations which will include the Recorder of Deed’s offices. &amp;nbsp;During the renovations the ROD offices will be
closed to the public from August 2023 through May of 2024. &lt;/font&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;font face="Arial, sans-serif" style="font-size: 16px;"&gt;The ROD will not be able to process paper recordings during
this period.&amp;nbsp;&amp;nbsp; All documents for
recording should be submitted electronically through one of the ROD approved
e-filing vendors.&lt;/font&gt;&lt;/strong&gt;&lt;/p&gt;

      <title>OTR Homestead Unit Suspending Processing Of Homestead Applications</title>
      <description>&lt;p&gt;The division of the DC Office of Tax and Revenue that
processes Homestead/Senior/Disabled applications (FP-100)&amp;nbsp; has announced
that, as of July 17, 2019, it will suspend the processing of applications, grant
benefits, and tax account adjustments.&amp;nbsp; This action was “taken to meet a
demanding billing timeline to reconcile tax accounts” associated with the
upcoming 2019 2&lt;sup&gt;nd&lt;/sup&gt; half tax year billing.&lt;/p&gt;

&lt;p&gt;&amp;nbsp;&lt;/p&gt;

&lt;p&gt;It is anticipated that the office will resume normal
processing on August 16, 2019, but that it may take up to 45 days for accounts
to be “updated and a corrected tax bill mailed”.&amp;nbsp;&amp;nbsp; Obviously, tax
bills that go out without current homestead reductions may be paid (by lenders
and others)&amp;nbsp;&amp;nbsp; in the interim, which may require refunds of
overpayments.&lt;/p&gt;

      <title>ALTA Urges CFPB to Warn Consumers About Wire Fraud Schemes When Purchasing a Home</title>

&lt;/p&gt;&lt;p&gt;&lt;strong&gt;Washington, D.C., April 4, 2017&lt;/strong&gt; — The &lt;font color="#1F497D"&gt;&lt;a href="https://www.alta.org/" target="_blank"&gt;American Land Title
Association&lt;/a&gt;&lt;/font&gt; (ALTA), the national trade association of the land title
insurance industry, in a letter &lt;font color="#000000"&gt;urged the Consumer
Financial Protection Bureau (CFPB) to issue an alert warning consumers about
wire fraud schemes attempting to steal funds for real estate closings.&lt;/font&gt;&lt;/p&gt;

&lt;p&gt;&amp;nbsp;“Despite efforts by the title industry and others to educate
consumers about the risk, homebuyers continue to be targeted,” said Michelle
Korsmo, ALTA’s chief executive officer. “With the spring homebuying season
underway, it’s vital to continue raising awareness about these schemes. The
CFPB should take this opportunity to protect consumers from criminals looking
to steal their money.”&lt;/p&gt;

&lt;p&gt;&amp;nbsp;The alert should provide tips to on how to consumers can
protect themselves and questions to ask to help determine if real estate
professionals have procedures in place to protect their money. ALTA has
educated its members over the past few years about these wire fraud schemes,
but the best defense is to inform consumers about the danger.&lt;/p&gt;

&lt;p&gt;&amp;nbsp;“Unfortunately, these criminals frequently target homebuyers
prior to the title company getting involved in the transaction,” Korsmo said.
“In many instances, they obtain access to unsecure email accounts used by
consumers or real estate professionals. They use this access to find
transaction patterns and details to make their fraudulent communications seem
legitimate. The criminals will instruct the buyers to send the funds to a
different account and the money vanishes in minutes.”&lt;/p&gt;</description>

      <title>DC WASA Authorization Form</title>

&lt;/p&gt;&lt;p&gt;&lt;font color="#1F497D"&gt;I am sure you all are aware of
the new requirement from DC Water that the Seller(or account holder) sign an
authorization form to receive any information on the account including
balances. I sent our general information request form for the Seller,in which
we &lt;u&gt;added authorization for DC Water &lt;/u&gt;to the existing language giving
authority for payoffs, etc.&lt;/font&gt;&lt;/p&gt;

&lt;p&gt;&lt;font color="#1F497D"&gt;Below is their authorization for our

      <title>U.S. House Passes ALTA-Driven TRID Bill with Veto-Proof Majority</title>

&lt;/p&gt;&lt;p&gt;&lt;strong&gt;Washington, D.C.&lt;/strong&gt; -&lt;strong&gt; October 7, 2015&lt;/strong&gt; — The &lt;a href="http://www.alta.org/"&gt;American Land Title Association&lt;/a&gt; (ALTA), the
national trade association of the land title insurance and real estate
settlement services industries, released the following statement following
tonight’s passage of the Homebuyers Assistance Act, H.R. 3192, by a &lt;a href="http://clerk.house.gov/evs/2015/roll540.xml"&gt;vote 303 to 121&lt;/a&gt; in the
U.S. House of Representatives:&lt;/p&gt;

&lt;p&gt;&amp;nbsp;“Tonight’s overwhelming bipartisan and veto-proof vote shows
that the House of Representatives recognizes the need for consumers to continue
to receive a positive and compliant real estate transaction,” said Michelle
Korsmo, ALTA’s chief executive officer. “We greatly appreciate the support of
Reps. Reps. French Hill (R-AK) and Brad Sherman (D-CA) and their efforts to
pass this important legislation.” &lt;/p&gt;

&lt;p&gt;&amp;nbsp;"We urge the Senate to pass this bill immediately so
that our ALTA members and the broader real estate members can focus on
delivering quality service to consumers when buying a home or refinancing a
mortgage. Without certainty, service providers are likely to close fewer
transactions to ensure compliance with TRID, which will delay homeownership for
consumers around the country,” Korsmo continued.&lt;/p&gt;

      <title>DISB Commissioner Barlow Responds to DCLTA</title>
      <description>&lt;p&gt;DISB Insurance Commissioner Philip Barlow has responded to DCLTA's 
letter regarding the proposed DC settlement agent rate examination.&amp;nbsp; The

 I am certain you will agree that the response is somewhat 
disappointing, it also sheds some light on DISB and Mr. Barlow's 
expectations from the process.&amp;nbsp; In particular, Mr. Barlow states, as 
follows: "I also want to reiterate that the purpose of looking at&lt;br&gt;information
 from individual producers is not intended to be a compliance audit. 
Rather, we are using the examination format as the safest and most 
effective method of getting the information needed for Mr. Birnbaum' s 
charge and to better enable the DISB understand the elements necessary 
to carry out our responsibilities under District law for reviewing rate 
filings."&amp;nbsp; He also notes his interest in DCLTA's future presentation on 
rate avoidance issues specific to DC settlement practice.&amp;nbsp; &lt;br&gt;&lt;/p&gt;&lt;p&gt;We
 are preparing the presentation and hope to get a date on the calendar 
for March to meet again with DISB for this presentation.&amp;nbsp; DCLTA will 
need your assistance in preparing for this.&amp;nbsp; In particular we are 
looking for an "in the DC trenches" perspective on your most pervasive 
DC risk avoidance problems; practical examples of these issues; and, any
 memos, guidelines or other written material that will illustrate the 
problems or necessary remedial processes. &amp;nbsp; In our last letter to DISB

line is: &lt;b&gt;DISB will be sending questionnaires
to at least 10 DC settlement companies whom they will select and will expect
answers about how these agents conduct their business.&lt;span&gt;&amp;nbsp; &lt;/span&gt;Agents will be selected by DISB and DISB states
that responses will be kept confidential.&lt;span&gt;&amp;nbsp;
&lt;/span&gt;DISB’s examiner will then visit the 10 selected companies and spend
about 4 hours interviewing employees and following up on the questions and
answers.&lt;span&gt;&amp;nbsp; &lt;/span&gt;This process is permitted in a

&lt;/b&gt;As many of you are aware the District of Columbia’s Department of
Insurance, Security and Banking (DISB) is conducting a market conduct
examination of the DC’s title insurance rates. The stated goal of this
examination is to “evaluat[e] DC title insurance rates and examining issues
related to the operating environment in DC for title insurers and title
agents…to identify all title insurance and settlement service activities to
ensure that expenses associated with each set of activities are segregated or assigned
to just those activities. … to examine all title insurance and settlement
expenses to perform any evaluation of the reasonableness of the agent
commission.” &lt;/p&gt;

&lt;p&gt;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;
Specifically, it is currently not clear to the DISB “why DC title insurers are
paying 80 to 85% of the risk rate title &amp;nbsp; premium in commissions to title
agents.&amp;nbsp; District of Columbia Title Rate Examination: Revised Follow Up
Questions, November 6, 2014. &amp;nbsp;DISB is seeking to identify the specific
roles and activities of settlement &amp;nbsp; agents in a settlement of DC property
so that they can assess the cost to the consumer of products and services to
consumers. &lt;/p&gt;

&lt;p&gt;&amp;nbsp; &amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp; To
assist in this process and to make sure that all of our membership has a voice
in the process, I am inviting any interested settlement company member, or any
member in any aspect of our industry, to volunteer to communicate with DISB’s
representatives to educate them on the realities of their respective roles in
our industry.&amp;nbsp; It is my goal that the governmental unit that regulates our
industry is acutely aware of the work, professional judgment, training and
experience that goes into bringing a high quality experience and insurance
product to the citizens of the District of Columbia. &lt;/p&gt;

      <title>New ROD Requirements/Forms for Refinances and Modifications/Amendments</title>
      <description>&lt;p&gt;ROD has posted on its website general &lt;span style="color:red"&gt;recording requirements for commercial refinances and
modifications/amendments&lt;/span&gt;.&amp;nbsp; The requirements are in line with OTR’s
Notice of May 2014, and hopefully answer the questions of commercial filers in
terms of required supporting documentations.&lt;u5:p&gt;&lt;/u5:p&gt;&lt;/p&gt;&lt;p&gt;&lt;u5:p&gt;&amp;nbsp;&lt;/u5:p&gt;&lt;/p&gt;&lt;p&gt;The purpose of this document is to mainly enforce a uniform,
standard way of the information presented on the statement to the FP7.&amp;nbsp;
&amp;nbsp;A standardized statement to the FP-7 will assist filers to submit
relevant information and to present them in an order that facilitates an
effective and accurate review by ROD examiners. &amp;nbsp;&lt;u5:p&gt;&lt;/u5:p&gt;&lt;/p&gt;&lt;p&gt;&lt;u5:p&gt;&amp;nbsp;&lt;/u5:p&gt;&lt;/p&gt;&lt;p&gt;Below is the link to the newly posted document.&amp;nbsp; Please

      <title>DC Recorder of Deeds - Proposed Changes to FP-7, Part J.  COMMENTS REQUESTED</title>
      <description>&lt;p&gt;The Recorder of Deeds has reached out to DCLTA to get our members input on the proposed revisions to the FP7 Form. &lt;/p&gt; &lt;p&gt;&amp;nbsp;The
 main revision will focus on Part J of the FP7 which deals with 
consideration and its financing.&amp;nbsp; The current form does not provide for 
information on what portion of the loan is purchase money.&amp;nbsp; So, the 
intent is to have the filers separately show the purchase money amount 
or other exempt amounts vs. the non-exempt amounts. &lt;/p&gt; &lt;p&gt;&amp;nbsp;Please see the email below from Ida Williams, Recorder of Deeds, and provide your input by email. Thank you. &lt;br&gt;&lt;/p&gt;&lt;p&gt; &lt;/p&gt;&lt;blockquote&gt;&lt;p&gt;&lt;span style="color:#1F497D"&gt;The
 proposed revision aims at revamping Part J of the FP-7.&amp;nbsp; Currently part
 J provides fields for Cash, First Mortgage, Second Mortgage; Assumed.&amp;nbsp; 
There is Line 1 “Construction loan”; line 2 “Total Consideration”; line 3
 “Assessed value if no consideration or nominal”.&amp;nbsp; &lt;/span&gt;&lt;/p&gt; &lt;p&gt;&lt;span style="color:#1F497D"&gt;&amp;nbsp;&lt;/span&gt;&lt;/p&gt; &lt;p&gt;&lt;span style="color:#1F497D"&gt;DC
 Code section 42-1103 (b-1)(2) provides for recording requirements of a 
purchase money deed of trust.&amp;nbsp; One of the provisions is that a purchase 
money DOT should recite on its face the amount of purchase money being 
secured by the instrument.&amp;nbsp; The industry and ROD practice so far has 
been to overlook this requirement. &amp;nbsp;Very rarely do purchase money DOT-s,
 commercial and residential, conform with this legal requirement.&amp;nbsp; The 
current FP7 doesn’t provide for separate fields for the purchase money

Superior Court, the D.C. Court of Appeals held that the foreclosure of a
condominium lien can extinguish the lien of a deed of trust.&amp;nbsp; The case,
which was decided August 28, 2014, is &lt;em&gt;Chase Plaza Condominium Association, Inc.
and Darcy, LLC,&amp;nbsp; v. JP Morgan Chase Bank, N.A.,&lt;/em&gt;&amp;nbsp;&amp;nbsp; &lt;p&gt;&lt;br&gt;&lt;/p&gt;The
primary issue in the case was whether the special 6 month priority given to
condominium association dues under D.C. Code § 42-1903.13 (a)(2) resulted in a

      <title>DISB releases regulations relating to the implementation of the recently passed amendment to the foreclosure mediation statute</title>

&lt;p style="MARGIN: 0in 0in 0pt"&gt;&lt;font face="Arial"&gt;&lt;font size="3"&gt;&lt;/font&gt;&lt;/font&gt;&amp;nbsp;&lt;/p&gt;
&lt;p style="MARGIN: 0in 0in 0pt"&gt;&lt;font size="3"&gt;&lt;span style="FONT-FAMILY: 'Arial', 'sans-serif'; COLOR: #333333"&gt;&lt;font face="Arial"&gt;The new website which became effective February 24th, 2014 was a project slated to take place since 2009.&amp;nbsp; I wish it did happen at that time, so Mr. Todd could take the heat for all the anomalies which are expected and inherent in any project of this nature and magnitude. &amp;nbsp;&lt;/font&gt;&lt;/span&gt;&lt;span style="FONT-FAMILY: Symbol; COLOR: #333333"&gt;&lt;span&gt;J&lt;/span&gt;&lt;/span&gt;&lt;/font&gt;&lt;/p&gt;
&lt;p style="MARGIN: 0in 0in 0pt"&gt;&lt;font face="Arial"&gt;&lt;font size="3"&gt;&lt;/font&gt;&lt;/font&gt;&amp;nbsp;&lt;/p&gt;

&lt;p style="MARGIN: 0in 0in 0pt"&gt;&lt;font face="Arial"&gt;&lt;font size="3"&gt;&lt;span style="FONT-FAMILY: 'Arial', 'sans-serif'; COLOR: #333333"&gt;The new website looks different from the one we all were so used to and loved.&amp;nbsp; Please let’s allow ourselves time to get acclimated to the new way the information is presented.&amp;nbsp; The major concern from all the abstractors I have talked to is the loss of some functionalities that were available in the old website.&amp;nbsp; I have conveyed all those issues to the developer in order to make the appropriate changes in the system.&amp;nbsp; However, I would also prefer to have an all inclusive, comprehensive list of the main search capabilities the new system should have to assist searchers in their work.&amp;nbsp; Please take a look at the list of issues below and let me know if there is anything else the website should provide in terms of title searching.&amp;nbsp; The issue of printing out for free copies that were previously purchased in the old system is not something that can be addressed at this time, so please do not include it.&lt;/span&gt;&lt;/font&gt;&lt;/font&gt;&lt;/p&gt;

&lt;P style="MARGIN: 0in 0in 10pt"&gt;&lt;FONT size=3&gt;&lt;FONT face=Calibri&gt;&lt;SPAN&gt;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp; &lt;/SPAN&gt;DCLTA President-elect Leslie Kostelecky and I attended the ALTA Annual Convention in Florida this past week.&lt;SPAN&gt;&amp;nbsp; &lt;/SPAN&gt;The location was wonderful and the discussion stimulating.&lt;SPAN&gt;&amp;nbsp; &lt;/SPAN&gt;The attendees and speakers included innovators and strong leaders in the title industry.&lt;SPAN&gt;&amp;nbsp; &lt;/SPAN&gt;Many of the sessions focused on the CFPB regulatory changes and the related adjustments of the lending industry.&lt;SPAN&gt;&amp;nbsp; &lt;/SPAN&gt;CFPB’s new “RESPA/TILA” regulations are expected before the end of the year.&lt;SPAN&gt;&amp;nbsp; &lt;/SPAN&gt;This new Rule will impose a new combined HUD-1/TILA form and possibly an entirely new process (“Will the lender be required to complete the HUD-1 and not the settlement agent?”) &lt;SPAN&gt;&amp;nbsp;&lt;/SPAN&gt;DCLTA encourages our members to learn and respond to this new environment which will help you remain competitive and successful.&lt;SPAN&gt;&amp;nbsp; &lt;/SPAN&gt;DCLTA will stay on top of the CFPB rules and regulations and we will update you regarding compliance. &lt;/FONT&gt;&lt;/FONT&gt;&lt;/P&gt;
&lt;P style="MARGIN: 0in 0in 10pt"&gt;&lt;B&gt;&lt;I&gt;&lt;U&gt;&lt;FONT size=3&gt;&lt;FONT face=Calibri&gt;CFPB IS ALREADY STIRRING UP THE ENFORCEMENT POT&lt;/FONT&gt;&lt;/FONT&gt;&lt;/U&gt;&lt;/I&gt;&lt;/B&gt;&lt;/P&gt;
&lt;P style="MARGIN: 0in 0in 10pt"&gt;&lt;FONT size=3&gt;&lt;FONT face=Calibri&gt;&lt;SPAN&gt;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp; &lt;/SPAN&gt;My conversations with our colleagues and peers from across the country are somewhat sobering.&lt;SPAN&gt;&amp;nbsp; &lt;/SPAN&gt;I heard of situations were CFPB’s regulators, joined by armed federal agents have visited settlement companies to interview staff, out of the owner’s presence. The regulators wanted to know how the settlement company was drafting Best Practices policies and whether those policies were actually being followed in the day to day workings of the company.&lt;SPAN&gt;&amp;nbsp; &lt;/SPAN&gt;I also heard of several instances where national lenders have contacted agents just days before a settlement and required completion of comprehensive forms, similar to the Best Practices pillars. The lender required satisfactory completion before loans would be funded.&lt;SPAN&gt;&amp;nbsp; &lt;/SPAN&gt;It is clear that the regulators are hearing ALTA’s touting of its ‘Best Practices’ as an answer to regulatory reform and are putting pressure on lenders and the title industry to test compliance.&lt;SPAN&gt;&amp;nbsp; &lt;/SPAN&gt;It is more important now than ever to review the ALTA Best Practices and to implement them in your business.&lt;SPAN&gt;&amp;nbsp; &lt;/SPAN&gt;This preparation will give you an opportunity to be “lucky” and prepared when and if you are faced with inquiries from the regulators or lenders.&lt;SPAN&gt;&amp;nbsp; &lt;/SPAN&gt;You can get started on ALTA’s Best Practices at: &lt;/FONT&gt;&lt;/FONT&gt;&lt;A href="http://www.alta.org/bestpractices/index.cfm"&gt;&lt;FONT color=#800080 size=3 face=Calibri&gt;http://www.alta.org/bestpractices/index.cfm&lt;/FONT&gt;&lt;/A&gt;&lt;FONT size=3&gt;&lt;FONT face=Calibri&gt; .&lt;/FONT&gt;&lt;/FONT&gt;&lt;/P&gt;

&lt;P style="MARGIN: 0in 0in 10pt"&gt;&lt;FONT size=3&gt;&lt;FONT face=Calibri&gt;&lt;SPAN&gt;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp; &lt;/SPAN&gt;Locally, our regulator the Department of Insurance, Securities and Business (DISB) has also been busy.&lt;SPAN&gt;&amp;nbsp; &lt;/SPAN&gt;DISB has informally proposed regulations to implement - B20-0268 "SAVING D.C. HOMES FROM FORECLOSURE” law.&lt;SPAN&gt;&amp;nbsp; &lt;/SPAN&gt;The notice and proposed regulations will be on the DCLTA web site (&lt;/FONT&gt;&lt;/FONT&gt;&lt;A href="https://dclta.com/"&gt;&lt;FONT color=#800080 size=3 face=Calibri&gt;www.dclta.com&lt;/FONT&gt;&lt;/A&gt;&lt;FONT size=3&gt;&lt;FONT face=Calibri&gt; ) and a stakeholder’s meeting is scheduled for this week.&lt;SPAN&gt;&amp;nbsp; &lt;/SPAN&gt;DCLTA is taking an active role in reviewing and commenting on the rule, where necessary.&lt;SPAN&gt;&amp;nbsp; &lt;/SPAN&gt;We are pleased that DISB has taken our prior comments and included them in the latest version of the law.&lt;SPAN&gt;&amp;nbsp; &lt;/SPAN&gt;The focus of our efforts will be to make sure that those protections remain in the rule at implementation.&lt;SPAN&gt;&amp;nbsp; &lt;/SPAN&gt;We will keep you informed on this process.&lt;/FONT&gt;&lt;/FONT&gt;&lt;/P&gt;
&lt;P style="MARGIN: 0in 0in 10pt"&gt;&lt;FONT size=3&gt;&lt;FONT face=Calibri&gt;&lt;SPAN&gt;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp; &lt;/SPAN&gt;The DC City Council and has also announced a hearing on three (3) pending tax sale bills relevant to our industry: Bill 20-23, the “Residential Real Property Equity and Transparency Act of 2013”, Bill 20-318, the “Senior Citizen Real Property Tax Relief Act of 2013”, and Bill 20-476, the “District Real Property Tax Sale Act of 2013”.&lt;SPAN&gt;&amp;nbsp; &lt;/SPAN&gt;The Public Hearing Announcement and the text of the bills will be posted on the DCLTA website: &lt;/FONT&gt;&lt;/FONT&gt;&lt;A href="https://dclta.com/"&gt;&lt;FONT color=#800080 size=3 face=Calibri&gt;www.dclta.com&lt;/FONT&gt;&lt;/A&gt;&lt;FONT size=3&gt;&lt;FONT face=Calibri&gt;. These laws intend to give the elderly, veterans and those owing only modest amounts in taxes broader rights to avoid losing their homes to tax sales.&lt;SPAN&gt;&amp;nbsp; &lt;/SPAN&gt;DCLTA’s focus for this proposed legislation is to see that whatever rights are provided to homeowners, there is finality in the bills.&lt;SPAN&gt;&amp;nbsp; &lt;/SPAN&gt;We need certainty that a homeowner must raise all of his rights in the sale and tax sale foreclosure process and not be permitted to renew challenges or raise them for the first time in a subsequent law suit after a Tax Deed has been issued.&lt;SPAN&gt;&amp;nbsp; &lt;/SPAN&gt;We will keep you informed of developments in these laws.&lt;/FONT&gt;&lt;/FONT&gt;&lt;/P&gt;
